Terms of Service

By accessing, browsing, or using the Desi Guide platform (including desi.guide, mobile web experiences, merchant workspaces, and ambassador portals), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access or use the platform. To use our platform, you must be at least 18 years of age and reside in the United States or have the legal capacity to form a binding contract under applicable United States federal and state laws.

Desi Guide provides a multi-tier profile architecture serving consumers, business merchants, and field ambassador scouts: • Tier 1 (General Consumer / Community Member): Allows searching directory listings, submitting reviews, purchasing event tickets, claiming promotional deals, and accessing matrimony biodata. • Tier 2 (Merchant & Business Owner): Allows claiming, managing, and updating verified restaurant, grocery, or service profiles, deploying digital menu boards to in-store screens, and managing CRM customer inquiries. • Ambassador & Field Scout Network: Community scouts authorized to scout, photograph, and report local Desi establishments to preserve directory accuracy. Scouts act as independent community contributors and are not employees or legal agents of Desi Guide. • Tier 3 (Super Admin & Moderation): Administrative staff ensuring platform compliance, dispute resolution, and security oversight.

Business owners claiming an entity must submit proof of ownership (such as utility bills, state business registrations, or authorized phone verification). Claimed owners warrant that menu pricing, dietary declarations (Halal, Zabihah, Pure Vegetarian, Jain), and opening hours are truthful and accurate. Desi Guide provides cloud-managed digital menu displays for restaurant TVs. Merchants are solely responsible for ensuring their in-store hardware complies with local electrical standards and that menu content displayed does not infringe on third-party trademarks.

Ambassador field scouts submit business data to expand directory coverage in their local metro areas. When an ambassador scouts an unclaimed business, the listing is designated as "unclaimed_scouted". Upon a verified business owner claiming the profile, the listing undergoes a formal handover process, transferring full operational management to the verified merchant. Ambassadors agree never to solicit unauthorized fees or misrepresent themselves as business proprietors.

Users utilizing the Matrimony portal agree to provide accurate biodata and to respect mutual-consent communication boundaries. Scraping, redistributing, or publishing another user's matrimonial profile or family details outside the platform is strictly prohibited and subject to immediate account termination and legal remedies. Classifieds users agree that all advertised goods, room rentals, and professional services comply with all applicable local, state, and federal laws, including the Fair Housing Act.

All monetary transactions on Desi Guide (event ticket purchases, sponsored promotions, and merchant subscription tiers) are processed securely through certified payment gateways (such as Stripe). Desi Guide does not store complete credit card or debit card numbers on its servers. Event ticket purchases are subject to the specific organizer's stated refund policies. Desi Guide facilitates payment processing and ticket issuance but is not liable for event cancellations or schedule modifications made by third-party organizers.

You retain ownership of any reviews, photos, biodata, or business media you upload to Desi Guide. By submitting content, you grant Desi Guide a worldwide, non-exclusive, royalty-free license to host, display, and reproduce such content in connection with providing and promoting our platform. You warrant that your content does not violate copyright, trademark, privacy, or publicity rights of any third party. Infringing content will be promptly removed in accordance with the Digital Millennium Copyright Act (DMCA).

You agree not to engage in any of the following: • Posting fraudulent, deceptive, or defamatory reviews or business claims. • Harvesting, scraping, or utilizing automated crawlers without written consent. • Harassing, discriminating, or inciting hostility against any ethnic, religious, or linguistic community. • Circumventing authentication, security controls, or role isolation barriers. • Transmitting malware, viruses, or disruptive code.

THE DESI GUIDE PLATFORM, INCLUDING ALL DIRECTORIES, SERVICES, MATRIMONY LISTINGS, AND SAAS TOOLS, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DESI GUIDE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS WILL BE ERROR-FREE OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESI GUIDE INC., ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM, BUSINESS TRANSACTIONS BETWEEN USERS, OR RELIANCE ON FOOD ALLERGEN AND DIETARY DECLARATIONS.

These Terms are governed by and construed in accordance with the laws of the State of Delaware and the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or the platform shall be resolved through binding confidential arbitration administered by the American Arbitration Association (AAA) in Houston, Texas, on an individual basis. You waive any right to participate in a class-action lawsuit.
